Public Notice

Hearing on Proposed Amendments to the Washington Administrative Code—

Standards of Conduct for Students; Practice and Procedure

Washington State University will conduct a public hearing on proposed amendments to WAC chapter 504-26 – Standards of Conduct for Students and WAC chapter 504-04 – Practice and Procedure on May 10, 2017 at 4:00 p.m. in Lighty Student Services Building, Room 405, Pullman, WA 99164. Notice of this public hearing is hereby given in accordance with provisions of RCW 34.05.320(4).

The majority of the proposed amendments are already in place as emergency rules and are intended to be temporary in nature. They will be replaced by a further revision to the permanent rules once the Student Conduct Task Force completes its work later this year. For more information on this process, see https://president.wsu.edu/student-conduct-process/.

The proposed amendments are intended to update and clarify the standards of conduct for students including, but not limited to, student conduct hearings and appeals. On December 1, 2016, the Washington Court of Appeals, Division III, issued a decision in the case of Arishi vs. Washington State University, 196 Wash. App. 878, 385 P.3d 251 (2016). The Court held that universities are required to use full adjudications under the Washington Administrative Procedure Act for certain student disciplinary matters. These rules implement changes to WSU’s student conduct process to comply with the Court’s decision. Additionally, the rule in WAC 504-04-110 sets forth areas where WSU’s full adjudications will differ from the model rules of procedure in WAC Chapter 10-08. These are based on Title IX of the Civil Rights Act of 1964, its implementing regulations, and guidance from the federal Office for Civil Rights regarding Title IX.

The University will adopt the amendments based on the statutory authority found in RCW 28B.30.150.
